The Challenge
Our clients held a valid Certificate of Occupancy over a prime commercial property. A rival party had obtained a forged deed of assignment and filed an action seeking to eject our clients.
Our Strategy
We set aside the ex parte injunction, filed a counter-claim for declaration of title and damages, and proved the forgery with expert handwriting evidence and Land Registry records.
The Outcome
The Court declared our clients the rightful owners, ordered immediate possession, awarded N45 million in damages, and issued a perpetual injunction against the defendant.
